Family Court: new practice directions

The Family Court has issued three new practice directions:

PRACTICE DIRECTION: NO. 1 OF 2009

Revocation of Case Management Directions
Preamble
Amendments to the Family Law Rules 2004 which commence on 1 March 2009 implement and support a new case management pathway and docket system.
The case management directions issued under Practice Direction No. 3 of 2004 are therefore no longer applicable.
Revocation of Practice Direction
Practice Direction No. 3 of 2004 ‘Case Management Directions’ is revoked with effect from 1 March 2009.
The revocation of this Practice Direction does not revive any earlier Practice Direction revoked by it.

PRACTICE DIRECTION: NO. 2 OF 2009

Revocation of Trial of Initiating Application and Response to Initiating Application




Preamble

Amendments to the Family Law Rules 2004 which commence on 1 March 2009 implement the Initiating Application (Family Law) and Response to Initiating Application (Family Law) forms, following a trial of these forms.

The forms - Initiating Application (Family Law) and Response to Initiating Application (Family Law) - have been approved by the Chief Justice pursuant to Rule 24.04(1) for the purposes of the Family Law Rules 2004.

Practice Direction No. 4 of 2006 is therefore no longer required.

Revocation of Practice Direction

Practice Direction No. 4 of 2006 ‘Trial of new forms for Initiating Application and Response to Initiating Application’ is revoked with effect from 1 March 2009.

Revocation of Children’s Cases Program and Child-related proceedings (Division 12A) Practice Directions

Revocation of Practice Direction


The following Practice Directions are revoked with effect from 1 March 2009:

  • Practice Direction No. 2 of 2004 – The Children’s Cases Program
  • Practice Direction No. 2 of 2005 – Practice Direction for the Melbourne Implementation of the Children’s Cases Program Incorporating the Child Responsive Pilot
  • Practice Direction No. 3 of 2005 – The National Children’s Cases Program
  • Practice Direction No. 2 of 2006 – Child-related proceedings (Division 12A)


The revocation of these Practice Directions does not revive any earlier Practice Direction revoked by them.
